The Munich Court found for infringement of a DryLyte S. L. technical IP-Right by OTEC Präzisionsfinish GmbH

GPAINNOVA, a leading innovator in the metal surface finishing industry, is proud to announce that its affiliate DryLyte S. L. (“DryLyte”) has successfully asserted its German Utility Model 20 2017 007 607 U1 (“Utility Model”) against OTEC Präzisionsfinish GmbH (“OTEC”) in first instance proceedings before the District Court Munich I (“Landgericht München I”), Germany (court ref. 21 O 13122/23).

With decision of February 5th, 2025, the District Court Munich I found that OTEC has infringed the Utility Model in Germany.

The decision deals with OTEC’s devices EF-SMART and EF-PERFORMANCE used together with MicroFinishing Balls and electrolyte liquid, particularly “DL4”, preventing –once enforced– the manufacture, offer, placing on the market or use in the Federal Republic of Germany or to import or possess for the aforementioned purposes. In addition, under German case law, the decision also covers devices and components that are core-identical to the aforementioned ones, where the metal removal process from the part to be treated (workpiece) is being carried out mainly by the particles that have absorbed electrolyte liquid.

The decision is not yet final and legally binding and OTEC has appealed the decision of the District Court on February 28th, 2025 (court ref. of the Appeal: 6 U 659/25 e).

However, DryLyte may – as a whole or in part – preliminarily enforce the granted claims for injunctive relief, information and accounting upon deposit of a respective security.

GPAINNOVA considers the decision to mark the second successful litigation against OTEC. As previously announced, the District Court Düsseldorf had found for infringement of Drylyte’s European Patent 3 372 711 B1 in Germany (court ref. 4c O 19/23) on July 2nd, 2024 – with Appeal Proceedings pending before the Court of Appeals Düsseldorf (court ref. I-2 U 67/24).

The decision affirms GPAINNOVA in its commitment to enforce the rights granted by its intellectual property and prevent further unauthorized use of its technology, if circumstances demand to do so.
