In this decision, the Munich District Court found <strong>infringement of the German utility model DE 20 2017 007 610.1 \u201cSmoothing and polishing device\u201d<\/strong> in favour of DryLyte, S.L.<\/p>\n<p>&nbsp;<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-88473 aligncenter\" src=\"https:\/\/www.dlyte.com\/wp-content\/uploads\/sites\/8\/2025\/10\/DLyte_finishing.jpg\" alt=\"Metal part treated with DLyte\" width=\"697\" height=\"380\" srcset=\"https:\/\/www.dlyte.com\/wp-content\/uploads\/sites\/8\/2025\/10\/DLyte_finishing.jpg 697w, https:\/\/www.dlyte.com\/wp-content\/uploads\/sites\/8\/2025\/10\/DLyte_finishing-300x164.jpg 300w, https:\/\/www.dlyte.com\/wp-content\/uploads\/sites\/8\/2025\/10\/DLyte_finishing-500x273.jpg 500w\" sizes=\"auto, (max-width: 697px) 100vw, 697px\" \/><\/p>\n<p>&nbsp;<\/p>\n<p>After reception of the enforceable copy, to be issued by the Court, GPAINNOVA will immediately proceed with the <strong>security deposit provision required under German law<\/strong> to enable the <strong>preliminary enforcement of the decision<\/strong>.<\/p>\n<p>As a result of these steps, the first-instance judgment <strong>is expected to become effective in the coming weeks<\/strong>, which will preliminarily confer binding effects on the decision.<\/p>\n<p>In the decision, the Court ordered OTEC inter alia <strong>to refrain from manufacturing, offering, marketing, or using in Germany \u2013or importing and possessing for such purposes\u2013 a system for smoothing and polishing metal parts<\/strong> <strong>by electroerosion wherein ion transport takes place through solid bodies<\/strong>. Furthermore, the Court also ordered OTEC to provide DryLyte, S.L. with information and accounting concerning the infringement.<\/p>\n<p>This action ensures that\u00a0said Court orders shall be obeyed by OTEC,<strong> even during the pending appeal<\/strong>,\u00a0further bolstering DryLyte\u2019s position in safeguarding its proprietary technology and intellectual property.<\/p>\n<p>The preliminary enforcement proceedings do not alter the fact that the decision is yet not final, as OTEC appealed the decision of the District Court.<\/p>\n<p>Pau Sarsanedas, CEO &amp; President of GPAINNOVA stated: \u201cWe believe that this enforcement highlights the court\u2019s decision and confirms GPAINNOVA as <strong>the rightful owners of the active particle polishing system<\/strong><em>.<\/em>\u201d<\/p>\n<p>GPAINNOVA remains open to collaborating with customers, partners and distributors who wish to work with DLyte technology under fair, reasonable and non-discriminatory conditions.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>About GPAINNOVA and DLyte<\/strong><\/h2>\n<p>GPAINNOVA is an international group specializing in advanced surface finishing technologies, with more than 100 granted patents and over 80 applications pending.
